Caorunn "10 Year Switch" Contest

Official Rules


  1. Eligibility:

    To participate in the Contest, you must meet all of the following criteria:

    1. Be a legal resident of the United States, 21 years of age or older;
    2. Be employed as a professional bartender in Washington, DC or any state of the United States OTHER THAN Alabama, Idaho, Iowa, Maine, Michigan, Mississippi, Montana, New Hampshire, North Carolina, Ohio, Oregon, Pennsylvania, Utah, Vermont, Virginia, West Virginia or Wyoming; AND
    3. Have received an invitation from an authorized representative of International Beverage Ltd. ("International Beverage" or "Sponsor").

    Members of the general public – i.e., all persons OTHER THAN those who meet the above-indicated criteria -- are not eligible to participate in the Contest. (Invitation is valid only for the individual who received same directly from authorized representative of International Beverage; invitation is NOT transferable.) Without limiting the foregoing, employees, officers or directors of any of the following entities and members of their immediate families (spouses, and parents, siblings and children and their respective spouses, regardless of where they reside) or their same households, whether or not related, are also not eligible: International Beverage, Odd Form of Sin Ltd., Luctor International LLC d.b.a 375 Park Avenue Spirits, their respective parent companies, divisions, affiliates, subsidiaries, printers, advertising and promotion agencies and other entities/persons involved in the development, conduct or administration of this Contest.

    Contest is offered only in the United States EXCEPT FOR Alabama, Idaho, Iowa, Maine, Michigan, Mississippi, Montana, New Hampshire, North Carolina, Ohio, Oregon, Pennsylvania, Utah, Vermont, Virginia, West Virginia or Wyoming.

    Contest is void in Alabama, Idaho, Iowa, Maine, Michigan, Mississippi, Montana, New Hampshire, North Carolina, Ohio, Oregon, Pennsylvania, Utah, Vermont, Virginia, West Virginia, Wyoming, elsewhere and where prohibited or restricted by law.

    IF YOU DO NOT LIVE IN THE UNITED STATES OR OTHERWISE DO NOT MEET THE ABOVE-INDICATED ELIGIBILITY CRITERIA (INCLUDING, BUT NOT LIMITED TO EMPLOYMENT AS A PROFESSIONAL BARTENDER IN ONE OF THE AFOREMENTIONED "VOID" STATES), DO NOT ATTEMPT TO ENTER THE CONTEST AS IT IS NOT INTENDED FOR YOU.

  2. Contest Period:

    The Contest Period is comprised of the following:

    1. Entry Period: March 18th 2019 at 12:01 a.m. Eastern Time (ET) – May 17th, 2019 at 11:59:59 p.m. ET
    2. Judging Period: May 20 - 31, 2019
    3. Selection of Finalists: On/about June 3, 2019
    4. Notification of Finalists: On/about June 7, 2019
    5. International Final (Determination of Winner): On/about July 31, 2019.

  3. Object of the Contest:

    International Beverage is looking for recipes for interesting, creative cocktails using Caorunn handcrafted premium Gin. Your 10 Year Switch cocktail must celebrate our Scottish heritage while also embracing the influence of American culture. We'll be looking for the following attributes:

    1. Fusion of Scottish heritage and American influence through inventive use of ingredients, flavors and style.
    2. Accentuating the character of Caorunn Gin by taking inspiration from at least one of our five celtic botanicals (rowan berry, heather, dandelion, coul blush apple, bog myrtle).
    3. Well-balanced and crafted taste profile delivering depth in every drop.
    4. Distinctiveness of serve through visual appeal and creative presentation.

  4. To Enter:

    Go to caorunn.liquor.com ("Website"). After confirming that you are 21 years of age or older, follow the posted instructions and:

    1. complete an entry form with your name, email address and other required information;
    2. enter your Caorunn Gin cocktail recipe only in the indicated area (recipe will NOT be accepted as attachment), along with the name for the cocktail;
    3. attach a color photo (no larger than 5 MB) of the cocktail yielded by following the recipe instructions.

    Check the box indicating your agreement to these Official Rules and affirming that the cocktail recipe and that the photo of same are your original work and do not violate the rights of any third party. YOUR ENTRY WILL NOT BE ACCEPTED IF THIS BOX IS NOT CHECKED. Then, click the "Submit" button to submit the entry.

    Entry (completed entry form, recipe, name of cocktail and photo of cocktail) must be received by May 17, 2019 at 11:59:59 p.m. ET. Once submitted, recipes/photos of cocktails/names of cocktails cannot be supplemented or modified in any respect. No partial or piecemeal submissions will be accepted; all elements of entry must be submitted during the same on-line session. Sponsor may acknowledge receipt of entry via email, but such acknowledgment merely indicates that the submission has been received and does not constitute any representation as to eligibility of entry.

    There is a limit of one (1) entry per person. Entry must be the work of a single person. Group/joint/team entries are NOT allowed, with the sole exception that a person other than the entrant him/herself may take the photo of the completed cocktail (but, for the avoidance of doubt, only the person submitting the entry will be considered the entrant).

    Data charges may apply to use of mobile device for Contest participation. You may be charged by your wireless carrier for submitting an entry. Be sure to check your wireless carrier's pricing plan before participating. Wireless Internet access may not be available in all areas.

  5. Restrictions on Entries:

    1. Cocktail Recipe

      1. Drinks must contain a minimum of 0.9 oz (approximately 25ml) of Caorunn Gin, with Caorunn Gin being the dominant ingredient;
      2. May be in the form of a long or short drink with a minimum volume of 4 oz. (approximately, 120 ml), BUT a shot serve is NOT allowed;
      3. Must be solely the original work of entrant him/herself;
      4. May be shaken, stirred, blended or thrown;
      5. Must create a potable beverage;
      6. Drinks should have a maximum of 7 easily obtainable ingredients, including drops, dashes and garnishes and Caorunn Gin.
      7. The only dairy ingredients permitted are eggs, milk or cream.
      8. No hot drinks. May be served straight-up or over ice (whether cubed, cracked or crushed);
      9. Must include simple, clear and easy-to-follow instructions for preparation;
      10. Must express required quantities of ingredients in terms of fluid oz./ounces (or ml/milliliters), and the use of the terms "drops" and/or "dashes" is limited to bitters/sauces; and, fruit juice quantities must also be expressed in ounces/milliliters (by way of example, "squeeze of lime" is NOT acceptable)
      11. Home-made syrups, cordials and bitters are allowed on the provision that a viable, commercially available substitute could be used alternatively, and must be fully explained (recipe and technique) to the judging panel.
      12. Drinks must be hand-shaken, stirred or built and require no specialist equipment not normally found in a top tier bar.
      13. Must NOT include any content/comment other than the recipe instructions; and
      14. The '10 Year Switch' cocktail should have its roots in a recognized 'classic cocktail' from the contestants' industry (i.e., professional bartending), and also deliver a fusion of Scottish heritage and American influence through the use of ingredients, flavors and style.

    2. Cocktail Ingredients.

      1. May include fruit juices, syrups, drops or dashes†;
      2. Must be readily available to obtain via purchase at a grocery store/market or otherwise;
      3. May include homemade ingredient(s);
      4. Garnishes may be mounted on sticks, skewers, straws, forks or other common bar accessories;
      5. Garnishes must be edible (without limitation, fruits, herbs, leaves, spices are allowed);
      6. Must be nonpoisonous (without limitation, tobacco is NOT allowed);and
      7. Must be lawful under U.S. state and federal law (without limitation, any type or drug or psychotropic agent is NOT allowed).

      †Solid garnishes do not count as ingredients; e.g., citrus fruit zest spray does not count as an ingredient if identified as a garnish.

    3. Photo of Cocktail.

      1. Must be truthful and accurate, showing cocktail as created by following instructions in cocktail recipe;
      2. Must have been taken during Entry Period;
      3. May be presented in any shape or type of glass, cup, or other sanitary drinking vessel;
      4. May be taken by an individual other than the entrant provided that the entrant has secured any and all necessary usage rights from such other individual;
      5. Must NOT include any content/comment (other than name of cocktail); and
      6. Must NOT be edited or manipulated by use of photo-editing software or any other artifice or equipment.

    4. In General.

      1. The recipe/photo and name of cocktail must NOT violate the trademark, copyright, right of privacy, right of publicity or other rights of any third party;
      2. The recipe/photo and name of cocktail must NOT be inappropriate, obscene or otherwise unfit for publication (e.g., include hate speech, profanity, advocate violence, drug use or any illegal act);
      3. The recipe/photo and name of cocktail must NOT adversely affect the business reputation or goodwill of International Beverage, its Caorunn handcrafted premium Gin product or Liquor.com
      4. The recipe/photo and name of cocktail must NOT defame or disparage Sponsor or the judging panel.
      5. Sponsor shall determine in its sole discretion if a recipe and/or photo and/or name of cocktail is void based on violation of the criteria set forth in this subsection or any of the preceding subsections. Should a recipe and/or photo and/or name of cocktail be determined to be in violation of such criteria, Sponsor may in its sole discretion on a case-by-case basis, provided time permits, allow the entrant to cure the defect(s) and re-submit the recipe and/or photo and/or name of cocktail (as appropriate). However, should Sponsor not extend such opportunity to a given entrant due to time constraints or for any other reason, Sponsor shall NOT have any liability of any kind.

  6. Grant of Rights in Recipe/Photo/Name of Cocktail:

    Entrant and third party photographer (if applicable) each grant to Sponsor and its designees (including but not limited to Liqour.com. and Luctor International LLC d.b.a. 375 Park Avenue Spirits) the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicenseable right and license to use, perform, exhibit, reproduce and/or otherwise exploit the recipe and/or photo and/or name of cocktail (as applicable) in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to entrant and third party photographer (if applicable). Entrant and third party photographer (if applicable) each waive any "Moral Right of Authors" (Droit Moral) in the recipe and/or photo and/or name of cocktail (as applicable) pursuant to any U.S. or foreign law. Entrant and third party photographer (if applicable) each further agree, upon Sponsor's request and without compensation, to sign any and all necessary and appropriate documents so as to effect, perfect or record such grant of license rights.

    Entrant and third party photographer (if applicable) each each further expressly acknowledge that Sponsor and its designees (including but not limited to Liqour.com. and Luctor International LLC d.b.a. 375 Park Avenue Spirits) have wide access to ideas, stories and other literary/artistic materials submitted to each of them from outside sources or being developed by their own respective employees and that such ideas/stories/literary/artistic materials may be competitive with, similar to (or even identical to) the recipe and/or photo and/or name of cocktail and that Sponsor and its designees (including but not limited to Liquor.com and Luctor International LLC d.b.a. 375 Park Avenue Spirits) shall have no liability to entrant or any third party in conjunction therewith. Entrant and third party photographer (if applicable) each further understand and agree that Sponsor and its designees (including but not limited to Liqour.com. and Luctor International LLC d.b.a. 375 Park Avenue Spirits) have no fiduciary duty whatsoever with regard to the recipe and/or photo and/or name of cocktail, including any duty of confidentiality as to same.


  7. Selection of Finalists & Winner:

    To determine the five finalists, a judging panel (comprised of representatives of Sponsor and may include Mr. Gaz Regan‡) will review all eligible cocktails (i.e., recipe, photo and name cocktails) from all eligible entrants. The Finalists will each win the opportunity to participate at the International Final in New York, New York on July 31, 2019; see Finalist Prize below. Eligible cocktails will be judged on concept, and photograph presentation, and their drink will be marked on taste, nose, balance and garnish. Each of these criteria will receive equal weight.

    For the final, our scoring system has been developed to illustrate that when two cultures come together the results can be exceptional. By awarding points for a celebration of Scottish heritage and American influence we elevate this competition from a simple cocktail competition to something unique. Bartenders and their drinks will be marked out of 60 points. 50 points relate to meeting of the cocktail and serve criteria. 10 points will be awarded based on presentation and delivery.

    ‡Subject to their availability and respective professional commitments, Sponsor shall have no liability if one (1) or more of the identified individuals do not participate in the judging.

    Finalist Prize (5):

    Each finalist will receive a trip to New York City and the opportunity to compete in the International Final. Trip package consists of round trip coach air transportation for finalist from a major commercial airport near finalist's home to a major commercial airport near New York City (selected by Sponsor), and two (2) nights lodging (standard accommodations). Approximate Retail Value ("ARV"): $1,000. Actual value of prize package will vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. Finalist Prize is subject to the Prize Restrictions set forth in Section 9 below.


  8. Main Prize:

    The winner of 10YR Switch Contest will receive the following prize package:

    At Sponsor's discretion, winner's drink may become one of Sponsor's recommended cocktails in the USA.

    The winner will win a unique opportunity to live the life of his/her UK counterpart – by taking part in an unprecedented bar switch. Winner will receive a trip to the UK, consisting of round trip coach air transportation for the winner from a major commercial airport near winner's residence to a major commercial airport in the UK (selected by Sponsor in its sole discretion); up to five (5) nights' lodging (standard accommodations, double occupancy); the opportunity for the winner to work behind one of the UK's coolest bars (selected by Sponsor in its sole discretion); an evening hosted by Sponsor's brand ambassador experiencing various UK bars; various local experiences in the UK host town (determined by Sponsor); two (2) days in Scotland's Speyside region (included in the five days' lodging listed above), including a personal tour of Balmenach Distillery with Gin Master Simon Buley (subject to his schedule/availability). ARV of Main prize: $5,000. Actual value of prize package will vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. Main prize is subject to the Prize Restrictions set forth in Section 9 below.

  9. Prize Restrictions:

    No transfer, assignment or substitution of any prize (in whole or in part) is allowed, except that Sponsor reserves the right to substitute a similar prize of equal or greater value. Prize cannot be redeemed or exchanged for cash. All applicable taxes on Prize are winner's sole responsibility and winner understands and agrees that the value of Prize will be reported to the Internal Revenue Service via 1099 Tax Form. Each winner must complete the trip on dates selected by Sponsor (finalist trip to the International Final is currently contemplated to be July 30-31, 2019) or prize will be forfeited without compensation of any kind and an alternate winner will be selected (i.e., the entrant whose cocktail is ranked below the winner(s) who has/have been verified as being eligible and in compliance with these Official Rules.) Trip must be booked at least thirty (30) days prior to departure. Travel and accommodations are subject to availability and blackout dates. Sponsor will determine airline and flight itineraries in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Winner is solely responsible for obtaining valid passports and any other documents necessary for international travel. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Winner must comply with all applicable venue rules and regulations or the prize may be forfeited.  Winners must conduct themselves in a socially responsible, appropriate, well-behaved manner at all times during the trip. Should a winner fail to do so, Sponsor reserves the right to terminate the trip without further notice and may seek other remedies against the winner. Additional restrictions apply. All elements of the itinerary will be determined by Sponsor in its sole discretion. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Sponsor is not responsible for any travel delays, flight cancellations or difficulty. If travel delays, cancellations or difficulty prevent arrival in time for any and all elements of trip, Sponsor is not responsible for awarding any compensation in lieu thereof. Any changes to completed travel arrangements, once booked, are the sole responsibility of the winner, and are solely at the winner's expense. Each winner hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the trip. Grand Prize winner will be required to provide a major credit card upon hotel check-in, and all in-room charges will be charged to the credit card. Any damage to the room will be the responsibility of the Grand Prize winner. Sponsor bears no responsibility if any element or detail of a prize is canceled, postponed or becomes unavailable for any reason. Should any element or detail of the prize become unavailable, the Sponsor shall have no obligation to the winner aside from providing the remaining portion of the prize, minus any unavailable element or detail.

  10. Notification of Prize Winners:

    Potential finalists and the Main Prize winner will be notified via email and/or phone and must complete, sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where legal) within five (5) business days of date of notification. Should a potential finalist or Main Prize winner fail to timely sign and return the Affidavit of Eligibility/Release, Prize will be forfeited without compensation of any kind and an alternate winner selected (as discussed above).

  11. General Conditions/Limitations of Liability:

    By participating, you agree to abide by and be bound by these Official Rules and the decisions of Sponsor and the judging panel, which are final and binding in all respects and not subject to appeal. Use of programmed, automated, robotic or like means to enter is prohibited. Proof of transmission of entry does not constitute proof of receipt of same. International Beverage and Luctor International LLC d.b.a. 375 Park Avenue Spirits expressly disclaim any and all liability for:

    1. entries that are lost, late, illegible/garbled, corrupted, irregular, inaccessible, misdirected, stolen or incomplete, all of which are void;
    2. any incomplete, incorrect or inaccurate information, whether caused by tampering, hacking, equipment malfunction/failure or other cause;
    3. any error, omission, interruption, deletion, defect, delay in operation or transmission of emails, communications line failure, theft or destruction or unauthorized access to, or alteration of entries;
    4. any problems or technical malfunctions, disruptions or failures of any kind, including telephone network or lines, computer on-line systems, servers or providers, software or programming (including entries not received due to system failure, disconnects, or other cause) or for damage to one's computer or mobile device (or information stored thereon) due to participation in the Contest.

    International Beverage further reserves the right, at its sole discretion, to (as applicable) disqualify any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Contest and void all associated entries. The preceding in no way precludes International Beverage and/or Odd Form of Sin Ltd. and/or and Luctor International LLC d.b.a. 375 Park Avenue Spirits from taking other actions against such individuals so as to protect their respective legal rights. The failure of International Beverage to enforce any provision of these Official Rules in any particular circumstance shall not constitute the waiver of such provision.

    ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

  12. Release of Rights:

    1. Right of Publicity. By participating in the Contest, you agree to the use of your name, likeness, voice, photograph and/or other indicia of persona for advertising/publicity/trade purposes by Sponsor and its designees (including but not limited to the Liquor.com. and Luctor International LLC d.b.a 375 Park Avenue Spirits), in any manner, in any and all media, now or hereafter devised, worldwide in perpetuity, without compensation or notice, except where prohibited by law.
    2. Release of Liability. By participating in the Contest, you release, indemnify and agree to hold harmless Sponsor, Liquor.com., Luctor International LLC d.b.a 375 Park Avenue Spirits, their respective parent companies, subsidiaries, affiliates, divisions and agencies, and all of their respective employees, officers, directors, agents and representatives, as well as Mr. Simon Difford, Mr. Simon Buley and Mr. Tristan Stephenson personally, from any and all liability arising from participating in the Contest, any Contest-related activity and/or acceptance, receipt, possession or use/misuse of Prize (as applicable).

  13. Force Majeure:

    If, for any reason, the Contest (or any part thereof) is not capable of running as planned by reason of computer virus, bug, system malfunction, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and make the Prizes available to be won from among all eligible entries received prior to the action taken by Sponsor or otherwise in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on the Website.

  14. DISPUTE RESOLUTION/GOVERNING LAW:

    To the fullest extent permitted by law, by participating in the Contest, you agree that:

    1. any and all disputes regarding the Contest or these Official Rules shall be governed by the internal, substantive law of Kentucky (i.e., without regard to choice of law/conflict of law rules of Kentucky or of any other jurisdiction);
    2. you are subject to the personal and exclusive jurisdiction of the courts of the United States District Court for the Western District of Kentucky or Kentucky court situate in Jefferson County, Kentucky;
    3. you waive any right of change of venue, inconvenient forum or the like;
    4. any action will be brought by you individually (NOT as part of a class action);
    5. your recovery in any such action is limited to actual costs involved in participating in the Contest (if any), with all rights to attorneys' fees and any and all damages (including special, compensatory, punitive, consequential damages) or other forms of relief being expressly waived.
